Governments increasingly contractual staff hire kar rahe hain – fixed-term, consolidated pay, limited benefits. Yeh people often same kaam karte hain jo regular employees karte hain, lekin unke legal rights alag hote hain.
Contractual employees usually:
- Specific contract period ke liye hire hote hain,
- Renewal pure discretion pe depend karta hai (subject to policy),
- Pension, seniority, promotion jaise benefits se largely excluded hote hain,
- Termination ke case me service rules ke full safeguards nahi, but contract + natural justice principle apply hota hai.
Courts ne multiple baar hold kiya hai ki long service automatically regularisation guarantee nahi karti, jab tak policy ya statute esa na bole. Lekin sham “contract” model jahan years tak same people low benefits pe kaam karate rakhe jate hain, judicial criticism attract karta hai.
Discrimination (same work, vastly unequal pay without justification), arbitrary non-renewal, ya victimisation-based termination challengeable ho sakta hai, specially jab State employer ho jahan constitutional norms apply hote hain.
Contract join karte waqt hi terms ka realistic assessment zaruri hai – future expectations clear ho to disappointments aur disputes dono kam hote hain.
