Paper pe dono similar lag sakte hain – aap kisi aur ki property use kar rahe ho. Lekin lease aur licence ka legal difference bahut critical hai, specially eviction, rights, and stamp/registration angle se.
Lease:
- Party ko limited saalon ke liye interest in property milta hai,
- Exclusive possession ka strong indicator – aap hi control karte ho space ko,
- Eviction ke liye proper notice, proceedings, aur kabhi-kabhi rent control protection apply ho sakte hain,
- Registration and stamp duty often mandatory.
Licence:
- Sirf permission to use premises, no interest in property,
- Owner theoretically possession retain karta hai,
- Termination relatively easier,
- Common in PG, co-working, hotels, or shared spaces.
Landlords kabhi-kabhi “licence” label use karke lease laws se bachna chahte hain, lekin courts substance dekhte hain – exclusive possession, duration, rent nature, and control. Agar arrangement actually lease jaisa behave kare, to sirf word “licence” use karne se aap legal obligations se bach nahi paoge.
Tenants/occupiers ke liye advice: document dhyan se padho – kya rights mil rahe hain, kya protections sacrifice kar rahe ho. Landlords ke liye: short-term drafting convenience later long-term litigation me convert ho sakta hai.
